The decision of PTI Chairman Imran Khan’s Polygraph Refusal to undergo forensic tests, such as a lie detector test, could hurt his case involving the May 9 incidents, said Anti-Terrorism Court (ATC) Judge Manzer Ali Gill.

In a written order, the judge stated that the prosecution relies heavily on digital evidence. The prosecution will present this evidence in court. He made this remark after rejecting the prosecution’s request for more time to conduct additional forensic tests on Khan.

The judge added that Khan purposely refused to take the polygraph and photogrammetric tests, which included facial and voice recognition. He wanted to minimise the impact of the prosecution’s evidence.

Digital Evidence Can Remain Unopposed

Judge Gill emphasised that Khan could later question the digital proof. He could claim that the investigators failed to validate it with forensic tests.

The police had come to Adiala Jail twice to conduct the tests, but Khan denied. The court rejected the prosecution’s request for more time. It explained that in most cases, the investigating officer controls the accused during physical remand and can ensure their cooperation. In the case of Khan, he was in judicial custody in another case in Adiala Jail, which allowed him to decline.

The judge wondered how the investigators could end the investigation without the cooperation of the accused and noted that Khan not only refused in writing but also refused to see the investigating officer.

The judge rejected more time but instructed the IO to utilise other legal means to complete the inquiry.
